TERMS OF USE AND EVENT PARTICIPATION AGREEMENT

These terms of use apply to the website operated by BLACKFLAG Reklam Yapım Organizasyon Sanayi ve Ticaret Limited Şirketi (the “Company”), as well as participation in and ticket purchasing processes for the Istanbul Children’s Festival events organized by the Company. By using our website or purchasing a ticket, you are deemed to have accepted these terms.

1- General Provisions

This website provides information about the Company and the event and facilitates ticket sales. Every person who uses the website or purchases a ticket is deemed to have read, understood, and accepted all of these terms. The Company reserves the right to amend these terms in accordance with changes in legislation or operational requirements; the updated terms shall become effective as of the moment they are published on the website.

2- Ticket Purchase, Cancellation, and Refund Terms

Purchased tickets may not be transferred, sold, or exchanged to third parties for commercial purposes (for profit); if such a situation is detected, the tickets shall be unilaterally canceled by the Company without compensation.

No refunds shall be made for cancellation requests submitted by consumers for entirely discretionary/personal reasons regarding event tickets. By purchasing a ticket, the consumer acknowledges that the capacity and operational planning of the organization have been arranged accordingly.

Only in extraordinary circumstances that definitively prevent the consumer from attending the event and are proven by official/legal documents (such as a medical board/health report obtained from a fully equipped hospital or force majeure events documented by official authorities), and provided that a written application is submitted no later than 7 days before the event date, may a refund be considered after deducting operational expenses and ticketing infrastructure fees. Where less than 7 days remain until the event, no refund may be made under any circumstances, including force majeure.

If the event is completely canceled due to the Company’s own fault or decision, ticket prices shall be refunded by the Company within the legal period determined by the Company.

Mandatory and partial changes that may occur in the event schedule, times, or program content (such as the use of an alternative venue or changes to artists/events) due to force majeure circumstances beyond the Company’s control, such as adverse weather conditions, natural disasters, official declarations of mourning, or decisions of administrative authorities, shall not constitute a fundamental breach of contract and shall not give rise to any right to a ticket refund or compensation.

3- Event Participation and Safety Rules

The following rules shall be strictly enforced for the safety of participants and the order of the organization at the festival venue:

It is strictly prohibited to bring alcoholic beverages, illegal substances, flammable/combustible materials, firearms, or any kind of cutting or piercing tools into the venue.

Due to the festival concept, its crowded nature, and especially the safety and health of children, pets and all kinds of domestic/wild animals cannot be admitted to the venue under any circumstances.

As the event is child-oriented, children between the ages of 0 and 12 must remain under the continuous supervision and responsibility of their parents or legal guardians for the entire time they are at the venue.

Authorized security personnel appointed by the Company are authorized to conduct bag and personal searches within the limits of the law upon entry to the venue in order to ensure the life and property safety of participants.

Persons who fail to comply with these rules, disrupt the order of the organization, or endanger the safety of other participants may be removed from the festival venue without a refund of the ticket price.

4- Photography and Video Policy

General-area photography and video recordings are made at the festival venue for the purposes of general promotion of the organization, press releases, social media posts, and archival activities. Participants are deemed to have consented upon entering the venue to general crowd images included in these public and mass recordings.

The safety of children and participants is our priority. Due to the nature of the festival, spontaneous focused (close-up) recordings made on stages, in event areas, workshops, and booths are carried out as part of the organization’s promotional activities. Participants and parents acknowledge in advance that these moments may be photographed or recorded while their children are actively participating in festival activities (going on stage, participating in workshops, interacting with mascots, etc.). Parents who do not wish their children to appear as the focal subject in promotional or social media materials in any way must ensure that their children do not enter such recording areas and must immediately notify the staff at the venue.

Parents who do not wish their children or themselves to appear as the focal subject in promotional materials must submit their requests in writing to the press desk at the venue or to [email protected] no later than the end of the event day. In the event of retroactive objections submitted after the event date, the Company’s printed materials, published commercials, production budgets, and sponsorship/media agreements made with third parties shall be protected. In such cases, the Company undertakes only to remove the image from digital channels under its control (such as social media accounts) within a reasonable period; no request for destruction, collection, or compensation may be made against the Company for printed or already published materials.

5- Limitation of Liability

The Company is obligated to take all safety, occupational health, and general order measures required by applicable legislation at the festival venue. Participants are themselves responsible for safeguarding the personal belongings they bring with them (telephone, bag, wallet, etc.); the Company shall have no legal liability for loss, theft, or damage not caused by the Company’s fault. The general safety and supervision of child participants at the venue are the responsibility of their parents/guardians.

6- Intellectual Property Rights

All content appearing on the website and displayed/used at the festival venue, including logos, trademarks, trade names, slogans, original stage/workshop concepts, decoration designs, visual and audio materials, video/sound recordings, software, and all intellectual property rights related thereto, are exclusively owned by BLACKFLAG Reklam Yapım Organizasyon Sanayi ve Ticaret Limited Şirketi or are used by the Company within the scope of legal permissions.

These rights are protected under Law No. 5846 on Intellectual and Artistic Works, Law No. 6769 on Industrial Property, and applicable international legislation. Visiting the website or entering the festival venue does not grant participants any license, right of use, or authority to transfer these intellectual property rights.

Participants may not use photographs and videos they take at the festival venue for personal/social media purposes in a manner that damages the commercial reputation of the Company or the festival, or that serves as a basis for the commercial activities of third parties (advertising, sponsorship, etc.) without the Company’s written permission. Unauthorized copying, reproduction, distribution, adaptation, or commercial use of intellectual property elements belonging to the Company is strictly prohibited, and the Company reserves the right to pursue all legal and criminal remedies upon detection of an infringement.

7- Applicable Law and Resolution of Disputes

Turkish law shall apply to all disputes arising from these Terms of Use and Participation Agreement.

In consumer disputes, Consumer Arbitration Committees and Consumer Courts shall have jurisdiction within the statutory monetary limits. In commercial/corporate disputes, the Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction.

8- Effectiveness and Contact

These Terms of Use and Participation Agreement shall enter into force as of the moment they are published on the website. Users visiting the website are deemed to have accepted all provisions of this text in full at the time of their visit, while participants purchasing tickets are deemed to have accepted them in full at the time of purchase.
